Removing Hijab to Get Married?
Answered by Shaykh Faraz Rabbani

Can a man ask a woman to remove her scarf, in order to see what she looks like, when he goes to see her for the prospect of marriage? A sister was confused, because on an internet q&a site answered, If the boy's choice of marriage is based on seeing the girls hair, he may request to see her hair. Is this right according to the Hanafi school? What do the majority of scholars say?

Walaikum assalam,

This is not a position in the Hanafi school. Nor is it allowed according to the overwhelming majority of the fuqaha.

If one decides to marry someone, it is permitted to look at their face and hands only. This is permitted even if there is desire (shahwa), though only if ones intention is to fulfill the the sunna, not in to fulfill ones physical desires. [As explained in Haskafis Durr al-Mukhtar, and Ibn Abidins Radd al-Muhtar, Babal-Mass wal Nadhar fi Kitab al-Hadhr wal Ibaha]

It is agreed upon in the Hanafi, Maliki, and Shafi`i schools that it is only allowed in such circumstances to look at the face and hands. [Hanafi: Durr al-Mukhtar; Maliki: Sharh al-Saghir; Shafi`i: Tuhfat al-Muhtaj fi Sharh al-Minhaj]

Most of the fuqaha conditioned the permissibility of looking even to this extent with being: after one has otherwise made the determination to marry the person, and believes it is possible that one would in fact be able to get married to her. This is not a permission to shop around.

Walaikum assalam,
Faraz Rabbani.
