2nd one replied: "Because the ruling applies to someone who had illicit relations before marriage and is considered a Zaani or a Zaaniyah. It does not refer to someone who had illicit relation with some other than one's spouse.

Praise be to Allaah.

It is not permissible to marry a zaaniyah or zaani unless they have repented. If the man or woman has not repented then the marriage is not valid.
Allaah says (interpretation of the meaning):
�The adulterer � fornicator marries not but an adulteress � fornicatress or a Mushrikah; and the adulteress �fornicatress, none marries her except an adulterer � fornicater or a Mushrik [and that means that the man who agrees to marry (have a sexual relation with) a Mushrikah (female polytheist, pagan or idolatress) or a prostitute, then surely, he is either an adulterer � fornicator, or a Mushrik (polytheist, pagan or idolater). And the woman who agrees to marry (have a sexual relation with) a Mushrik (polytheist, pagan or idolater) or an adulterer � fornicator, then she is either a prostitute or a Mushrikah (female polytheist, pagan, or idolatress)]. Such a thing is forbidden to the believers (of Islamic Monotheism)�

There is a report concerning the reason for the revelation of this verse which makes the ruling clearer. Abu Dawood (2051) narrated from �Amr ibn Shu�ayb, from his father, from his grandfather, that Marthad ibn Abi Marthad al-Ghanawi used to smuggle prisoners from Makkah. There was in Makkah a prostitute called �Anaaq and she had been his friend. He said: I came to the Prophet (peace and blessings of Allaah be upon him) and said: O Messenger of Allaah, should I marry �Anaaq? He remained silent and did not answer me. Then the words �and the adulteress �fornicatress, none marries her except an adulterer � fornicater or a Mushrik� were revealed. He called me and recited them to me, and said: Do not marry her. Classed as saheeh by al-Albaani in Saheeh Abi Dawood." Alhamdullilah great answers to share with others in shaa Allah

Never mind I got it answered by two Hanbali scholars but I'd like to share the answers for the benefits of anyone else wondering or confused about this I know In fact some English Qurans clearly say adulterers like my own but this is what two scholars who actually live in Arabia from the kingdom and speak the language replied to me with:

"IT is a matter of translation; the verse didn�t say adulterer or adulteress, i,e, a married man and married woman. It said �zani� - male and �zaniah� - female regardless of whether they are married or not and you can be �zani� or �zaniah� and not be stoned- if you are not married. That said, the verse has different meanings. The word *marry* in the English translation isn�t precisely a true translation of the word نكاح�. The arabic word نكاح has different meanings; among them is the official marriage between man and woman. But it also could mean an illegal sexual intercourse. One meaning of the verse is that Allah tells us that a �zani� (a man) doing illegal sexual intercourse; can�t do it with a righteous woman; he does it usually with a woman of the his type �zaniah�. You won�t find a righteous man do this with a dirty woman. They are always of the same type. The same goes for �zaniah�."

Assalum Alaikum, in the Quran it says that an adulterer can only marry an adultress guilty of the same. How can this be possible if the Sharia is in place and they are stoned to death? Also, why in the Holy Quran does it specifically say flogging is prescribed for both fornication and adultery but yet hadith somehow over rules this can someone explain this to me? In shaa Allah.
