Many scholars have different opinions about the hajj badal especially for people who have passed away. As we know that the source of Islamic law is Al Quran and Hadith. And almost all Muslim scholars agree that the person in the hajj badal is still alive. But some of them differed when the person in the hajj badal had died. The following are the Hadith that allow Hajj Badal for people who have passed away: (Historical Hadith of book al-Tirmizi juz 2, p. 205; al-Nasa'i. juz 5, p. 116; al-Darimi, juz 2, p. 41; Ibn Majah juz 2, p. 969 compare with the Muslim book Shiyam no. 1939) “Buraidah stated that a woman came to the Apostle and then asked: my mother had died and she had not hajj, should I do it? The Apostle replied: Yes, serve your mother !” Refer to the Hadith above, some Muslim scholars have different opinions on the grounds that there's verse in the Qur'an and Hadith which are references that the person who had died will get nothing except the results of his own efforts. وَ£َن لَّيْسَ لِلْإِنسَانِ إِلَّا مَا سَعَى “And that man can have nothing but what he does.” (An Najm 53:39) Hadith: عَنْ £َبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ £َنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ إِذَا مَاتَ الْإِنْسَانُ انْقَطَعَ عَمَلُهُ إِلَّا مِنْ ثَلَاثٍ صَدَقَةٌ جَارِيَةٌ وَعِلْمٌ يُنْتَفَعُ بِهِ وَوَلَدٌ صَالِحٌ يَدْعُو لَهُ قَالَ £َبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ Al-Tirmizi, Muslim washiyyat, al-Nasai, Abu Daud Ibn Majah, Al-Darimi, book Muqaddimah “Abu Hurairah stated that Rasulullah Shallallahu 'Alaihi Wasallam said: if humans die, then their practice is cut off except for 3 (three) things, namely: Shadaqah Jariyah, useful knowledge, and prayers of pious children.” |

Yes,
that is Hajj Badal, and if we see its hadith that the person who is replaced
his/her Hajj is still alive, not the one who has passed away.
