A person who cannot perform Hajj or ๏ฟฝUmrah as a result of old age, permanent illness, or some weakness in his body due to which he cannot make the journey, should have somebody perform Hajj and ๏ฟฝUmrah on his behalf, and this is valid for him even if he regains his health after his representative had already entered into the state of Ihram for Hajj or ๏ฟฝUmrah. On the authority of al-Fadl Ibn ๏ฟฝAbbas t: A woman from al-Khath๏ฟฝam said, ๏ฟฝO Messenger of Allah, the obligation from Allah to perform Hajj came upon my father while he is very old and incapable of riding a camel.๏ฟฝ The Prophet ﷺ said: ๏ฟฝPerform Hajj on his behalf.๏ฟฝ [ Source: At-Tirmidhi.]
There are numerous conditions stipulated for the person performing Hajj on behalf of another: 1- He must have met the aforementioned conditions of Hajj. 2- He must have first performed Hajj for himself. When a person performs Hajj on behalf of another, but has not performed it for himself, such a Hajj on behalf of another person is not valid; thus the Hajj he performed for the other person then becomes for him, and it is considered as a valid Hajj for him in Islam. Evidence for this is what was confirmed on the authority of Ibn ๏ฟฝAbbas t: The Prophet ﷺ heard a man saying; ๏ฟฝLabbayka on behalf of Shubruma,๏ฟฝ the Prophet ﷺ asked: ๏ฟฝWho is Shubruma?๏ฟฝ He replied: ๏ฟฝA brother or a relative of mine.๏ฟฝ The Prophet then asked: ๏ฟฝHave you performed Hajj for yourself?๏ฟฝ He replied: ๏ฟฝNo.๏ฟฝ So the Prophet ﷺ said: ๏ฟฝPerform Hajj for yourself, then perform (Hajj) on behalf of Shubruma.๏ฟฝ [ Source: Abu Dawud.] hajj |

Yes,
that is Hajj Badal, and if we see its hadith that the person who is replaced
his/her Hajj is still alive, not the one who has passed away.

Many scholars have different opinions about the hajj badal especially for people who have passed away. As we know that the source of Islamic law is Al Quran and Hadith. And almost all Muslim scholars agree that the person in the hajj badal is still alive. But some of them differed when the person in the hajj badal had died. The following are the Hadith that allow Hajj Badal for people who have passed away: ุนููู ุจูุฑูููุฏูุฉู ููุงูู ุฌูุงุกูุชู ุงู ูุฑู๏ฟฝ£ูุฉู ุฅูููู ุงููููุจูููู ุตููููู ุงูููููู ุนููููููู ููุณููููู ู ููููุงููุชู ุฅูููู ๏ฟฝ£ูู ููู ู ูุงุชูุชู ููููู ู ุชูุญูุฌูู ๏ฟฝ£ููู๏ฟฝ£ูุญูุฌูู ุนูููููุง ููุงูู ููุนูู ู ุญูุฌููู ุนูููููุง ููุงูู ููููุฐูุง ุญูุฏููุซู ุตูุญููุญู (Historical Hadith of book al-Tirmizi juz 2, p. 205; al-Nasa'i. juz 5, p. 116; al-Darimi, juz 2, p. 41; Ibn Majah juz 2, p. 969 compare with the Muslim book Shiyam no. 1939) โBuraidah stated that a woman came to the Apostle and then asked: my mother had died and she had not hajj, should I do it? The Apostle replied: Yes, serve your mother !โ Refer to the Hadith above, some Muslim scholars have different opinions on the grounds that there's verse in the Qur'an and Hadith which are references that the person who had died will get nothing except the results of his own efforts. ูู๏ฟฝ£ูู ูููููุณู ููููุฅููุณูุงูู ุฅููููุง ู ูุง ุณูุนูู โAnd that man can have nothing but what he does.โ (An Najm 53:39) Hadith: ุนููู ๏ฟฝ£ูุจูู ููุฑูููุฑูุฉู ุฑูุถููู ุงูููููู ุนููููู ๏ฟฝ£ูููู ุฑูุณูููู ุงูููููู ุตููููู ุงูููููู ุนููููููู ููุณููููู ู ููุงูู ุฅูุฐูุง ู ูุงุชู ุงููุฅูููุณูุงูู ุงููููุทูุนู ุนูู ููููู ุฅููููุง ู ููู ุซูููุงุซู ุตูุฏูููุฉู ุฌูุงุฑูููุฉู ููุนูููู ู ููููุชูููุนู ุจููู ููููููุฏู ุตูุงููุญู ููุฏูุนูู ูููู ููุงูู ๏ฟฝ£ูุจูู ุนููุณูู ููุฐูุง ุญูุฏููุซู ุญูุณููู ุตูุญููุญู Al-Tirmizi, Muslim washiyyat, al-Nasai, Abu Daud Ibn Majah, Al-Darimi, book Muqaddimah โAbu Hurairah stated that Rasulullah Shallallahu 'Alaihi Wasallam said: if humans die, then their practice is cut off except for 3 (three) things, namely: Shadaqah Jariyah, useful knowledge, and prayers of pious children.โ |
