Sunan Abi Dawud 2083 (Book 12, Hadith 38) #22374
Marriage Without Consent

SUMMARY: A woman's marriage is void if it is done without the consent of her guardians. If there is cohabitation, she should receive her dower and if there is a dispute, the sultan (man in authority) will act as her guardian.

Narrated Aisha, Ummul Mu'minin: The Messenger of Allah said: The marriage of a woman who marries without the consent of her guardians is void. (He said these words) three times. If there is cohabitation, she gets her dower for the intercourse her husband has had. If there is a dispute, the sultan (man in authority) is the guardian of one who has none.
