Seeking Consent Before Marriage

SUMMARY: The Prophet Muhammad (PBUH) taught that a previously married woman should not be married without her consent and a virgin should not be married without her permission, which is indicated by her silence.

It was narrated from Abu Hurairah that: the Messenger of Allah said: "A previously-married woman should not be married until she is consulted, and a virgin should not be married until her consent is sought, and her consent is her silence".
حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ الدِّمَشْقِيُّ، حَدَّثَنَا الْوَلِيدُ بْنُ مُسْلِمٍ، حَدَّثَنَا الأَوْزَاعِيُّ، حَدَّثَنِي يَحْيَى بْنُ أَبِي كَثِيرٍ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ ـ ـ قَالَ ‏ "‏ لاَ تُنْكَحُ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ وَلاَ الْبِكْرُ حَتَّى تُسْتَأْذَنَ وَإِذْنُهَا الصُّمُوتُ

This applies to both previously married women and virgins alike; for a previously married woman, her consent must be explicitly sought out while for a virgin it can simply be assumed if she remains silent when asked about it. This hadith emphasizes the importance of respecting people’s autonomy in making decisions about their lives and bodies. It also highlights how marriage should only take place when both parties are willing participants in it.
