Marriage and Guardianship

SUMMARY: Marriage should be done with the permission of a guardian. If the person does not have a guardian, then the ruler is their guardian.

It was narrated that: Aisha and Ibn Abbas said: "The Messenger of Allah said: 'There is no marriage except with a guardian'. "According to the Hadith of Aishah: "And the ruler is the guardian of the one who does not have a guardian".
حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، عَنْ حَجَّاجٍ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، عَنِ النَّبِيِّ ـ ـ وَعَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، ‏.‏ قَالاَ قَالَ رَسُولُ اللَّهِ ـ ـ ‏"‏ لاَ نِكَاحَ إِلاَّ بِوَلِيٍّ ‏"‏ ‏.‏ وَفِي حَدِيثِ عَائِشَةَ ‏"‏ وَالسُّلْطَانُ وَلِيُّ مَنْ لاَ وَلِيَّ لَهُ
