Ruling on Children Born to Slave Women

SUMMARY: The Prophet (PBUH) ruled that a child born to a slave woman belongs to the owner of the bed, and instructed Saudah to observe Hijab before him.

It was narrated that 'Aishah said: Ibn Zam'ah and Sa'd (Ibn Abu Waqqas) referred a dispute to the Prophet concerning the son of Zam'ah's slave woman. Sa'd said : " O Messenger of Allah my brother (Utbah bin Abu Waqqas) left instructions in his will that when I come to Makkah, I should look for the son of the slave woman of Zam'ah and take him into my care"'.Abd bin Zam’ah said: "He is my brother and the son of the slave woman of my father; he was born on my father's bed". The Prophet ffi saw that he resembled 'Utbah, and said: "He belongs to you, O 'Abd bin Zam'ah. The child is for the bed. Observe Hijab before him, O Saudah". (sahih)
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، قَالَتْ إِنَّ عَبْدَ بْنَ زَمْعَةَ وَسَعْدًا اخْتَصَمَا إِلَى النَّبِيِّ ـ ـ فِي ابْنِ أَمَةِ زَمْعَةَ ‏.‏ فَقَالَ سَعْدٌ يَا رَسُولَ اللَّهِ أَوْصَانِي أَخِي إِذَا قَدِمْتُ مَكَّةَ أَنْ أَنْظُرَ إِلَى ابْنِ أَمَةِ زَمْعَةَ فَأَقْبِضَهُ ‏.‏ وَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وَابْنُ أَمَةِ أَبِي وُلِدَ عَلَى فِرَاشِ أَبِي ‏.‏ فَرَأَى النَّبِيُّ ـ ـ شَبَهَهُ بِعُتْبَةَ فَقَالَ ‏ "‏ هُوَ لَكَ يَا عَبْدُ بْنُ زَمْعَةَ ‏.‏ الْوَلَدُ لِلْفِرَاشِ وَاحْتَجِبِي عَنْهُ يَا سَوْدَةُ

EXPLANATIONS:
This hadith is about a dispute between two people concerning the son of Zam'ah's slave woman. Sa'd said that his brother left instructions in his will that when he comes to Makkah, he should look for the son of the slave woman and take him into his care. 'Abd bin Zam'ah said that he was born on his father's bed. The Prophet saw that he resembled Utbah and ruled in favor of 'Abd bin Zam'ah, saying "He belongs to you, O 'Abd bin Zam'ah. The child is for the bed." He then instructed Sauda bint Zama’h, who was present there, to observe hijab before him as she would do with any other man not related by blood or marriage. This hadith teaches us an important lesson about justice and fairness; it also shows us how important it is for us as Muslims to follow rulings given by our Prophet Muhammad ﷺ even if they don't seem fair at first glance. It also teaches us about observing hijab which is an essential part of our faith as Muslims.
