The Rights of a Pre-Islamic Marriage

SUMMARY: A woman who had two husbands, one of whom she was married to before becoming Muslim, was taken away from her second husband and returned to her first husband by the Prophet.

It was narrated from Ibn 'Abbas that: a woman came to the Prophet and became Muslim, and a man married her. Then her first husband came and said: "O Messenger of Allah, I became Muslim with her, and she knew that I was Muslim". So the Messenger of Allah took her away from her second husband and returned her to her first husband.
حَدَّثَنَا أَحْمَدُ بْنُ عَبْدَةَ، حَدَّثَنَا حَفْصُ بْنُ جُمَيْعٍ، حَدَّثَنَا سِمَاكٌ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ امْرَأَةً، جَاءَتْ إِلَى النَّبِيِّ ـ ـ فَأَسْلَمَتْ ‏.‏ فَتَزَوَّجَهَا رَجُلٌ ‏.‏ قَالَ فَجَاءَ زَوْجُهَا الأَوَّلُ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي قَدْ كُنْتُ أَسْلَمْتُ مَعَهَا وَعَلِمَتْ بِإِسْلاَمِي ‏.‏ قَالَ فَانْتَزَعَهَا رَسُولُ اللَّهِ ـ ـ مِنْ زَوْجِهَا الآخَرِ وَرَدَّهَا إِلَى زَوْجِهَا الأَوَّلِ

EXPLANATIONS:
This hadith speaks about the rights of a pre-Islamic marriage. It is narrated that a woman became Muslim and then married another man while her first husband was still alive. When the first husband found out, he went to the Prophet and told him what happened. The Prophet then took away the woman from her second husband and returned her to her original spouse. This shows that even if someone converts to Islam after being in an existing marriage, their rights are still respected according to Islamic teachings. It also teaches us that we should not enter into any kind of relationship with someone who is already married as it would be considered wrong in Islam.

The lesson here is that we should always respect people’s rights regardless of their religion or beliefs, as this is what Allah has commanded us in His book - The Quran - “And do not wrong one another” [ 4:129 ]. We must also remember that no matter how much time passes or how much our circumstances change, our commitments remain valid until they are fulfilled or annulled according to Islamic law.
