Sahih Muslim 1706c (Book 29, Hadith 57) #11565
Punishment for Drinking Alcohol

SUMMARY: This hadith is about the punishment for drinking alcohol, and how it was changed from forty lashes to eighty by Umar.

Anas b. Malik reported that Allah's Apostle gave a beating with palm branches and shoes, and that Abu Bakr gave forty lashes. When Umar (became the Commander of the Faithful) and the people went near to pastures and towns, he said (to the Companions of the Holy Prophet). What is your opinion about lashing for drinking? Thereupon Abd al-Rahman b. Auf said: My opinion is that you fix it as the mildest punishment. Then 'Umar inflicted eighty stripes.

EXPLANATIONS:
This hadith is about the punishment for drinking alcohol, which was changed from forty lashes to eighty by Umar. The Prophet Muhammad gave a beating with palm branches and shoes as a punishment for drinking alcohol, while Abu Bakr gave forty lashes. When Umar became the Commander of the Faithful, he asked his companions what their opinion was on lashing as a punishment for drinking alcohol. Abd al-Rahman b. Auf suggested that it should be set at the mildest possible punishment, so Umar then inflicted eighty stripes instead of forty. This hadith teaches us that punishments should be fair and just according to Islamic law, but also not too harsh or extreme in order to maintain justice and mercy in society. It also shows us that we should always seek advice from others when making decisions or judgments in order to ensure fairness and justice are upheld at all times.
