Marriage and Guardianship

SUMMARY: Marriage requires the permission of a guardian.

Narrated Abu Musa: The Prophet said: There is no marriage without the permission of a guardian. Abu Dawud said: The narrator Yunus also transmitted on the authority of Abu Burdah, and Isra'il narrated from Abu Ishaq on the authority of Abu Burdah.
حَدَّثَنَا مُحَمَّدُ بْنُ قُدَامَةَ بْنِ أَعْيَنَ، حَدَّثَنَا أَبُو عُبَيْدَةَ الْحَدَّادُ، عَنْ يُونُسَ، وَإِسْرَائِيلَ، عَنْ أَبِي إِسْحَاقَ، عَنْ أَبِي بُرْدَةَ، عَنْ أَبِي مُوسَى، أَنَّ النَّبِيَّ قَالَ ‏ "‏ لاَ نِكَاحَ إِلاَّ بِوَلِيٍّ ‏"‏ ‏.‏ قَالَ أَبُو دَاوُدَ هُوَ يُونُسُ عَنْ أَبِي بُرْدَةَ وَإِسْرَائِيلُ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي بُرْدَةَ

EXPLANATIONS:
This hadith is about marriage and the importance of having a guardian's permission before entering into it. The Prophet Muhammad (peace be upon him) said that there is no marriage without the permission of a guardian. This means that if someone wants to get married, they must have their guardian's approval first. This could be their father or another close relative who has been appointed as their legal representative. It is important to note that this does not mean that the guardian has complete control over who their child marries; rather, it serves as an extra layer of protection for both parties involved in the marriage contract. The hadith also mentions two other narrators - Abu Burdah and Isra'il - who transmitted this same message on behalf of Abu Musa.
