Rightful Ownership of Lost Items

SUMMARY: The Prophet Muhammad (PBUH) taught that if someone loses something and it is found in the possession of another person who bought it, then the original owner has more right to it than the buyer.

It was narrated from Samurah bin Jundub that the Messenger of Allah said: "If a man loses something, or it is stolen from him, and he finds it in the possession of a man who bought it, then he has more right to it, and the one who bought it should ask for his money back from the one who sold it to him'. "
حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، حَدَّثَنَا حَجَّاجٌ، عَنْ سَعِيدِ بْنِ عُبَيْدِ بْنِ زَيْدِ بْنِ عُقْبَةَ، عَنْ أَبِيهِ، عَنْ سَمُرَةَ بْنِ جُنْدُبٍ، قَالَ قَالَ رَسُولُ اللَّهِ ‏ "‏ إِذَا ضَاعَ لِلرَّجُلِ مَتَاعٌ أَوْ سُرِقَ لَهُ مَتَاعٌ فَوَجَدَهُ فِي يَدِ رَجُلٍ يَبِيعُهُ فَهُوَ أَحَقُّ بِهِ وَيَرْجِعُ الْمُشْتَرِي عَلَى الْبَائِعِ بِالثَّمَنِ

EXPLANATIONS:
This hadith teaches us about rightful ownership of lost items. It was narrated by Samurah bin Jundub that the Messenger of Allah said, “If a man loses something or it is stolen from him, and he finds it in the possession of a man who bought it, then he has more right to it, and the one who bought it should ask for his money back from the one who sold it to him.” This hadith emphasizes that if someone finds an item they have lost or had stolen in another person’s possession, they have more right to reclaim their property than whoever purchased or acquired them. The buyer should seek reimbursement from whoever sold them this item instead. This teaches us about justice and fairness when dealing with other people’s possessions as well as our own. We must always be honest and truthful when dealing with others so we can maintain peace and harmony within our communities.
